Terms of Service

Please read these terms carefully before using SnapAppraise. They outline your rights and responsibilities when using our service.

Welcome to SnapAppraise

These Terms of Service ("Terms") form a binding contract between you and SnapAppraise ("SnapAppraise," "we," "us," or "our"), based in Ontario, Canada. They govern your access to and use of snapappraise.com, our mobile-friendly web application, and related services (together, the "Service"). Our Privacy Policy is incorporated by reference.

By creating an account, uploading a photo, requesting a valuation, or otherwise using the Service, you agree to these Terms. If you do not agree, do not use the Service.

Who Can Use SnapAppraise

You may use the Service only if all of the following are true.

  • You are at least 18 years old or the age of legal majority where you live, whichever is greater.
  • You have the legal capacity to enter into a binding contract. If you are using the Service on behalf of a business, you represent that you are authorized to bind that entity, and "you" in these Terms refers to both you personally and that entity.
  • You are not on any applicable sanctions list and are not in a country subject to a sanctions or trade embargo that applies to you.
  • You will use the Service only for lawful purposes and in compliance with these Terms.

We may refuse, suspend, or terminate access for any user, at any time, for any reason permitted by law, including failure to meet these eligibility requirements.

Your Account

You need an account to use most features. We use a third-party identity provider for authentication.

You are responsible for the accuracy of the information you provide, for keeping it current, and for safeguarding the credentials you use to access the Service. Do not share your account or credentials. Notify us at support@snapappraise.com if you suspect unauthorized access.

You are responsible for activity under your account, except to the extent it results from our breach of these Terms or our security obligations.

We may require you to verify your identity, your email, or other information. We may suspend or close accounts that we reasonably believe to have been compromised, used in violation of these Terms, or created by a person who does not meet our eligibility requirements.

What the Service Does

SnapAppraise provides an automated, AI-generated jewelry valuation tool. You upload photographs of an item, along with any item details you choose to provide ("Inputs"); our system analyzes them and returns an estimated value range, a confidence indicator, an analysis of materials and gemstones, references to comparable sales, and a written summary explaining the factors that influenced the estimate (collectively, a "valuation").

The Service is currently free to consumers.

We may add, change, or remove features, change the AI models that power the Service, change the data sources we draw from, or pause portions for maintenance. We will use reasonable efforts to give meaningful notice of material changes that affect your use of the Service, but some changes may need to happen without advance notice.

AI Valuations: What They Are and What They Are Not

This is the most important section of these Terms. Read it carefully before relying on any valuation for any purpose.

Artificial intelligence and machine vision are evolving technologies. When you use SnapAppraise, you acknowledge and agree that:

  • A valuation may contain material inaccuracies even when it appears precise. A specific-looking value range, confidence indicator, or comparable-sale citation does not mean the underlying analysis is correct.
  • A valuation may misidentify metals, stones, hallmarks, brands, eras, settings, treatments, or weights, and may reference comparable sales that do not actually correspond to your item.
  • You should not rely on a valuation without independently confirming its accuracy with a qualified professional.

A SnapAppraise valuation is an automated estimate generated by software based on the Inputs you provide and on data the software has access to at the time of analysis. It is informational only. It gives you a rough sense of what an item may be worth in a general retail or resale context. It is not a substitute for professional judgment.

A SnapAppraise valuation is not a certified appraisal. It is not prepared by a certified gemologist, credentialed appraiser, or licensed jeweler. It does not meet the Uniform Standards of Professional Appraisal Practice (USPAP).

A SnapAppraise valuation is not an insurance valuation. Do not use it to schedule items on a homeowners, renters, or specialty jewelry insurance policy. Insurers typically require a written appraisal from a qualified professional and may deny coverage if you submit something else.

A SnapAppraise valuation is not legal documentation. Do not use it for probate, estate division, divorce proceedings, customs declarations, tax filings (including charitable contribution substantiation under IRS rules), bankruptcy filings, court submissions, lender collateral, or any other official purpose. Many of these uses require a qualified appraisal under specific regulatory standards.

A SnapAppraise valuation is not investment advice. We are not financial advisors and are not commenting on whether you should buy, sell, hold, insure, or do anything else with any item.

A SnapAppraise valuation is not a guarantee of any resale price, auction result, retail price, or buyer offer. The price an item fetches in a real transaction depends on many factors that an automated photo analysis cannot evaluate, including the condition of the item under direct examination, current market demand, the venue of sale, and many other variables.

You are solely responsible for any decision you make based on a SnapAppraise valuation, including any decision to keep, sell, insure, gift, or dispose of an item. We strongly recommend that you consult a qualified professional appraiser, gemologist, or jeweler before making any decision that has financial, legal, insurance, tax, or estate consequences.

Nothing in this section is intended to exclude, restrict, or modify any consumer rights that cannot be excluded under applicable law.

Your Inputs

You retain all ownership rights in your Inputs. We do not claim ownership of your photos or descriptions.

To operate the Service, you grant SnapAppraise a worldwide, non-exclusive, royalty-free, sublicensable license to host, store, copy, transmit, display, format, analyze, and process your Inputs solely to (a) provide the Service to you, (b) operate, support, and develop the Service, (c) ensure the integrity and security of the Service, and (d) comply with legal obligations. This license lasts as long as you keep your Inputs on the Service and for a reasonable period afterward to allow for backup expiration and legal retention.

We do not train SnapAppraise's AI models on your Inputs or valuations without your explicit consent. We may use de-identified, aggregated information derived from Inputs and valuations for internal analytics. Our handling of personal information is described in our Privacy Policy.

You represent and warrant that you own your Inputs or have all necessary rights to submit them, that your Inputs do not infringe any third party's rights, that your Inputs are not illegal or otherwise prohibited under these Terms, and that the information you provide is accurate to the best of your knowledge.

We may delete your Inputs and the valuations they generated if your account is closed, if your Inputs violate these Terms, if we are required to by law, or for other operational reasons. You are responsible for maintaining your own copies of any photographs you want to retain.

Acceptable Use

You agree to use the Service responsibly and in compliance with all applicable laws. The list below is not exhaustive. We may treat any conduct that is dishonest, abusive, dangerous, or that disrupts or harms the Service or other users as a violation of these Terms, even if it is not specifically called out.

You will not, and will not authorize anyone else to:

  • Upload or transmit content that infringes a third party's copyright, trademark, privacy, publicity, or other rights, including photographs you do not have the right to use.
  • Upload photographs of items you do not own or do not have authority to value.
  • Use the Service to develop, train, fine-tune, or evaluate any artificial intelligence model, machine learning system, or competing valuation product. Public marketing pages may be crawled by search engines and AI assistants in accordance with our robots.txt; this does not extend to authenticated areas, user-uploaded content, API endpoints, comparable sales data, or valuation outputs.
  • Reverse engineer, decompile, disassemble, or attempt to derive the source code, models, prompts, weights, or training data of the Service, except to the extent applicable law permits.
  • Probe, scan, test the vulnerability of, or breach any authentication or security measure, except with prior written authorization from support@snapappraise.com.
  • Use any robot, spider, scraper, or automated means to access the Service except for lawful crawling of public marketing pages in accordance with our robots.txt.
  • Interfere with the proper working of the Service, including by overwhelming, degrading, or impairing its operation, introducing harmful code, or circumventing rate limits or access controls.
  • Resell, sublicense, frame, mirror, or commercially exploit the Service or any part of it without our written permission.
  • Impersonate any person or entity, or misrepresent your affiliation.
  • Collect, harvest, or store information about other users without their consent.
  • Use the Service in any way that violates applicable export control or sanctions laws.

If we discover or reasonably suspect that you have violated this section, we may remove content, restrict your account, suspend or terminate your account, ban you from creating new accounts, refuse future service, report your conduct to law enforcement, and pursue any other remedies available to us.

Intellectual Property

SnapAppraise and its licensors own all rights, title, and interest in and to the Service, including the software, AI models and weights, prompts, comparable-sales database, valuation methodology, user interface, brand, logos, trademarks, and any improvements or aggregated outputs. These Terms do not transfer any of those rights to you.

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your own personal, non-commercial use (or, for business users, your own internal business use).

You may print or download a SnapAppraise valuation report for your personal records and may share it with a qualified appraiser, insurer, or other professional consulting on your behalf. You may not (a) republish a SnapAppraise valuation as if it were a certified appraisal, (b) attribute a SnapAppraise valuation to a person or institution that did not produce it, (c) modify it to misrepresent its content or limitations, or (d) use it in a way that violates these Terms.

Trademarks displayed on the Service that are not ours are the property of their respective owners. References to brands, designers, or maker marks (for example, in valuation outputs) are descriptive nominative references and do not imply affiliation, endorsement, or sponsorship.

If you believe content on the Service infringes your copyright, please contact us at support@snapappraise.com with the subject "Copyright Concern" and include a description of the work, the location of the allegedly infringing material, and your contact information.

Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITH ALL FAULTS, AND WITHOUT WARRANTIES OF ANY KIND. TO THE FULLEST EXTENT PERMITTED BY LAW, SNAPAPPRAISE AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AFFILIATES, SUPPLIERS, AND LICENSORS DISCLAIM ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, TITLE, ACCURACY, COMPLETENESS, AND ANY WARRANTIES ARISING FROM A COURSE OF DEALING OR TRADE USAGE.

WE DO NOT WARRANT THAT THE SERVICE OR ANY VALUATION IS ACCURATE, RELIABLE, COMPLETE, CURRENT, ERROR-FREE, SECURE, UNINTERRUPTED, FREE FROM VIRUSES, SUITABLE FOR ANY PARTICULAR PURPOSE, OR COMPLIANT WITH ANY REGULATORY STANDARD. WE SPECIFICALLY DO NOT WARRANT THE ACCURACY OF ANY VALUATION, COMPARABLE SALE, MATERIAL IDENTIFICATION, BRAND IDENTIFICATION, OR OTHER AI-GENERATED OUTPUT. PLEASE RE-READ THE AI VALUATIONS SECTION.

Some jurisdictions do not allow the exclusion of certain warranties or the limitation of statutory consumer guarantees. To the extent the law of your jurisdiction grants you a non-excludable warranty or guarantee, the disclaimers in this section do not apply to that warranty or guarantee.

Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT WILL SNAPAPPRAISE OR ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AFFILIATES, SUPPLIERS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, USE, GOODWILL, OR BUSINESS OPPORTUNITY, ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE, REGARDLESS OF THE THEORY OF LIABILITY AND REGARDLESS OF WHETHER SNAPAPPRAISE HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE FULLEST EXTENT PERMITTED BY LAW, THE TOTAL CUMULATIVE LIABILITY OF SNAPAPPRAISE AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AFFILIATES, SUPPLIERS, AND LICENSORS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE TOTAL FEES YOU PAID TO SNAPAPPRAISE IN THE TWELVE MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) FIVE HUNDRED U.S. DOLLARS ($500).

WITHOUT LIMITING ANY OTHER LIMITATION, SNAPAPPRAISE WILL NOT BE LIABLE FOR ANY DECISION YOU MAKE IN RELIANCE ON A VALUATION, FOR ANY DIFFERENCE BETWEEN A VALUATION AND A PRICE OBTAINED IN ANY ACTUAL TRANSACTION, FOR ANY INSURANCE CLAIM THAT IS DENIED OR REDUCED BECAUSE A SNAPAPPRAISE VALUATION WAS USED IN PLACE OF A QUALIFIED APPRAISAL, OR FOR ANY TAX, ESTATE, OR LEGAL CONSEQUENCE OF RELYING ON A SNAPAPPRAISE VALUATION.

You acknowledge that the limitations in this section are an essential part of the bargain between you and SnapAppraise, that the Service would not be offered on an as-is, free basis without these limitations, and that they apply even if a stated remedy fails of its essential purpose.

Some jurisdictions do not allow the exclusion or limitation of certain damages. To the extent the law of your jurisdiction does not allow a particular limitation, that limitation does not apply to you, but every other limitation continues to apply.

Indemnification

You will defend, indemnify, and hold SnapAppraise and its officers, directors, employees, agents, affiliates, suppliers, and licensors harmless from and against any third-party claim, loss, liability, or expense (including reasonable attorneys' fees) arising out of or relating to (a) your Inputs, (b) your breach of these Terms, (c) your violation of any law or third-party right, or (d) your use of the Service in a way not permitted by these Terms.

We will give you prompt notice of any claim and reasonable cooperation, and you will not settle any claim that imposes a non-monetary obligation on SnapAppraise without our written consent.

Suspension and Termination

You may stop using the Service at any time. You may close your account by contacting us at support@snapappraise.com.

We may suspend, restrict, or terminate your access at any time, with or without notice, for any reason permitted by law, including if we reasonably believe you have violated these Terms, if your use poses a security or legal risk, if continued service is no longer commercially viable for us, if required by law, or if we discontinue the Service.

When your account is terminated, your license to use the Service ends immediately. Provisions that by their nature should survive termination (including ownership of intellectual property, the limited license you grant in your Inputs for backups and legal retention, disclaimers, limitations of liability, indemnification, and the dispute resolution clause) will survive.

We are not liable to you or any third party for any termination, suspension, or restriction of access, except where applicable law expressly provides otherwise.

Changes to These Terms

We may update these Terms from time to time. When we make a material change, we will post the updated Terms with a new "Effective" date and, if you have an account, give you reasonable notice through the Service or by email. The updated Terms become effective on the date stated in the notice or, if no date is stated, when posted. Your continued use of the Service after the effective date constitutes acceptance of the updated Terms. If you do not agree, you must stop using the Service before the effective date.

Governing Law and Disputes

Governing law and venue. These Terms and any dispute arising out of or relating to these Terms or the Service are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of laws rules. The United Nations Convention on Contracts for the International Sale of Goods does not apply. Any judicial action that is permitted must be brought in the courts of Ontario, Canada, and you and SnapAppraise consent to the personal jurisdiction of those courts.

Specific jurisdiction notices. Nothing in these Terms is intended to exclude, restrict, or modify any consumer right that cannot be excluded under applicable law.

  • Ontario. Under the Ontario Consumer Protection Act, 2002, consumers retain non-excludable rights including the right to bring an action in the Superior Court of Justice. Nothing in these Terms limits or excludes those rights.
  • Quebec. If you reside in Quebec, the language of these Terms has been provided in English at your request, and any provision inconsistent with the Quebec Consumer Protection Act is unenforceable against you to that extent.
  • Other Canadian provinces. Consumers retain non-excludable rights under their applicable provincial consumer protection laws. Nothing in these Terms limits or excludes those rights.
  • California. Under California Civil Code § 1789.3, California users may report complaints to the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs, 1625 North Market Blvd., Suite N 112, Sacramento, CA 95834, or (800) 952-5210.
  • UK, EU, and Australia. Consumers in these regions have non-excludable rights under their local consumer protection laws (including the UK Consumer Rights Act 2015, the EU and UK GDPR, the Australian Consumer Law, and similar). Nothing in these Terms limits or excludes those rights.

Notices, Contact, and General

Notices. We may give you notice through the Service, by email to the address on your account, or by other reasonable means. You are responsible for keeping your account email accurate. You may give us notice by email to support@snapappraise.com. A mailing address is available upon request. Notices sent by email are effective when sent.

Contact us. Questions about these Terms: support@snapappraise.com.

Entire agreement. These Terms, together with the Privacy Policy, are the entire agreement between you and SnapAppraise regarding the Service. They supersede any prior or contemporaneous agreement on the subject.

No waiver. Our failure to enforce a provision is not a waiver. A waiver is effective only if in writing and signed by us.

Severability. If any provision is held unenforceable, that provision will be enforced to the maximum extent permitted, and the remaining provisions will remain in full effect.

Assignment. You may not assign your rights or obligations under these Terms without our prior written consent. We may assign these Terms freely, including to an affiliate or to a successor in connection with a merger, acquisition, or sale of assets.

Independent contractors. Nothing in these Terms creates an agency, partnership, joint venture, or employment relationship between you and SnapAppraise.

Language. These Terms were drafted in English. Where we provide a translation, the English version controls in the event of any inconsistency, except where applicable law requires otherwise.
